Who is exempt from stamp duty?

Purchasing a property? You may be exempt from tax duty. For example:

First-time homebuyers can avoid SDLT if their property purchase is below a certain value threshold.

During a divorce or civil partnership dissolution, transferring property between partners usually incurs no stamp duty.

Inheritances and gifted properties without an outstanding mortgage are also typically exempt.

Who pays stamp duty?

How much stamp duty will I pay on a second home?

When buying a second home, you’ll usually pay 3% stamp duty on top of the standard rate for your applicable band. This surcharge applies to both individuals and companies and is part of the government’s efforts to manage the housing market.

How is stamp duty calculated?

How do I pay stamp duty?

Once your property purchase is complete, your stamp duty needs to be paid to HM Revenue & Customs (HMRC). You usually have 14 days from the date of completion—that’s the day you become the owner of the property—to settle up. Failure to pay within the deadline can result in penalties and interest.

Most often, your solicitor, conveyancer, or legal advisor will handle the stamp duty payment on your behalf. They’ll submit a stamp duty return to HMRC and transfer the funds for you, ensuring all legal requirements are met. This payment includes any stamp duty due, and it’s often managed as part of the overall settlement of funds during the purchase process. The cost is typically part of their service and is factored into their fees, so you’ll likely pay them, and they’ll, in turn, pay HMRC.

Do you pay stamp duty on land?

When buying land, you may have to pay stamp duty if the purchase price is above a certain threshold. The exact amount you’ll need to put forward will depend on whether the land is intended for residential development or if it’s for commercial/mixed use. Residential plots typically follow the same stamp duty rates as houses, while commercial land has different rates.

Do you pay stamp duty on buy to let?

When purchasing a buy-to-let property, you’ll be required to pay higher rates of stamp duty land tax (SDLT) than if you were buying a home as a primary residence – currently a further 3% on top of the normal SDLT rates for each band.
